The Department of Justice (DOJ) has referred to Vice President Sara Duterte as a “self-confessed mastermind” following her public remarks about a supposed assassination plot targeting President Ferdinand “Bongbong” Marcos Jr., First Lady Louise “Liza” Araneta-Marcos, and Speaker Ferdinand Martin Romualdez.

In a Palace briefing, DOJ Undersecretary Jesse Hermogenes Andres stated that Duterte’s admission of a premeditated assassination plan would lead to legal action.

“The premeditated plot to assassinate the President as declared by the self-confessed mastermind will now face legal consequences,” Andres said. Law enforcement agencies are already investigating the matter.

Subpoena Issued to Vice President

The DOJ announced that a subpoena would be issued to Vice President Duterte to clarify her statements. NBI Director Jaime Santiago confirmed that the subpoena was prepared and will be served on Tuesday, November 26.

When asked about the rarity of serving a subpoena to a sitting vice president, Santiago said it may be unprecedented.

DOJ Investigation Underway

The DOJ is prioritizing the investigation to uncover potential steps taken to secure an assassin’s services, as stated by Andres. The National Bureau of Investigation (NBI) is tasked with tracing the identity of the individuals involved and determining the gravity of the situation.

“These are improper statements from a high-ranking government official,” Andres emphasized, adding that due process will be strictly observed.

Duterte’s Response

Vice President Duterte denied any wrongdoing, claiming her remarks were “maliciously taken out of logical context.” She criticized the National Security Council (NSC) for excluding her from their meetings while investigating the matter.

Duterte has stated that she will cooperate with the NBI’s investigation, saying, “I will gladly answer all their questions once summoned.”

Possible Legal Repercussions

Legal experts, including DOJ Prosecutor General Richard Fadullon, suggest Duterte’s actions could lead to disbarment, citing violations of the Code of Professional Responsibility and Accountability (CPRA).

Fadullon noted that Duterte acting as legal counsel for her chief of staff, Attorney Zuleika Lopez, is also questionable under the law. Public officials are generally prohibited from practicing their profession unless explicitly permitted.

Other potential charges include grave threats, sedition, and other criminal offenses. DOJ officials underscored that due process will be observed before filing any cases.

Impeachment Option

While DOJ officials acknowledged the seriousness of Duterte’s actions, they clarified that impeachment falls under the jurisdiction of Congress. Andres stated, “It is up to Congress to decide if this merits impeachment. Our role is to ensure that violations of the law are addressed.”
