Cebu-based LGBTQ+ advocate Jude Bacalso is set to post bail and file a motion for reconsideration after a Cebu City court issued a warrant for her arrest in connection with a Grave Slander by Deed case. The case stems from a misgendering incident involving Bacalso and a wait staff at a restaurant in July 2024.

Background of the Case

Bacalso faced five charges—Unjust Vexation, Grave Scandal, Grave Coercion, Grave Threats, and Slight Illegal Detention—all of which were dismissed due to lack of evidence. However, the prosecutor recommended filing a Grave Slander by Deed charge, which was not part of the original docket.

“We just learned about this today, so we haven’t had the time to prepare a response. We will file a motion for reconsideration,” Bacalso said.

She clarified that the arrest warrant was procedural, intended to give the court jurisdiction over her.

Bail and Legal Proceedings

Bacalso’s legal team is processing the necessary documents to post the ₱18,000 bail set by the Municipal Trial Court in Cities (MTCC) Branch 6.

Her arraignment and pre-trial conference are scheduled for January 23.

The July 2024 Incident

The controversy began when a photo circulated online showing Bacalso seated while a wait staff stood beside her. The photo, allegedly taken during an altercation where Bacalso was “berating” the waiter for addressing her as “sir,” sparked backlash on social media.

Bacalso denied the allegations, explaining that she was offering gender sensitivity information to the waiter and did not compel him to remain standing. She acknowledged the waiter’s error was an honest mistake and apologized to the restaurant staff, though the waiter involved was not present during her apology.

The restaurant has since issued a statement in support of its employee.

Looking Ahead

Bacalso reiterated her commitment to addressing the case through proper legal channels, stating, “We remain steadfast in narrating the facts and ensuring a fair resolution.”

Her camp expressed hope for a reconsideration of the case and a peaceful resolution to the matter.
